These terms govern the services Bali Customs Clearance — a member company of Juara Holding Group Limited — provides to you, and the use of this website. By instructing us to handle a shipment, or by accepting a quotation, you agree to them.

Where we have signed a separate written agreement with you, that agreement prevails over these terms to the extent of any conflict. Where it is silent, these terms fill the gap.

In these terms, “we” and “us” mean Bali Customs Clearance; “you” means the client instructing us; and “consignment” means the goods we are engaged to clear, forward or handle.

We act as a licensed customs broker (Pengusaha Pengurusan Jasa Kepabeanan, or PPJK) and logistics provider in Bali. Our services include:

• import and export customs clearance at Ngurah Rai International Airport and Benoa Harbour;
• declaration filing through the Indonesian customs system (CEISA), and settlement of duties and taxes on your behalf;
• HS code classification advice, customs valuation review and LARTAS permit management;
• air and sea freight forwarding, including FCL, LCL and consolidated cargo;
• door-to-door and inland transport within Bali and to other Indonesian destinations;
• aircraft ground handling, overflight and landing permits, and VIP passenger facilitation;
• yacht and vessel clearance, including CIQP coordination at Benoa;
• bonded warehousing and temporary import under bond.

We act as your agent in dealings with Indonesian authorities. We are not a carrier: where cargo moves by sea, air or road, it moves under the carrier’s own contract of carriage, and that contract governs the carriage itself.

Every quotation we issue is an estimate based on the information available when we issue it — the commodity, declared value, weight and volume, origin, routing and the documents you have shown us. Unless the quotation says otherwise, it is valid for 14 days.

A quotation will change if the facts change. The common causes are a different HS classification once the goods are inspected, a declared value that customs revalues, weight or volume that differs from the packing list, a permit requirement that only emerges on examination, or carrier rates and surcharges moving between quotation and booking.

We will tell you before incurring a charge that was not in the quotation, except where the charge is imposed by an authority or terminal and arises automatically — demurrage is the usual example — in which case we will tell you as soon as we know.

Import duty, value added tax, income tax under PPh 22, luxury goods tax where it applies, and any penalty assessed by customs are government charges. They are set by the Directorate General of Customs and Excise, not by us. Where we pay them on your behalf, we are passing money through, and they form no part of our fee.

The final assessment is made by customs on the declaration as lodged. Our pre-shipment calculation is a careful estimate, and we stand behind the care taken in making it, but we cannot guarantee that customs will reach the same figure.

The same applies to third-party charges: terminal handling, storage, demurrage, detention, quarantine fees, fumigation, inspection charges, port dues and carrier surcharges. These are for your account at cost.

A customs declaration is a legal statement, and it is made on the information you give us. You therefore agree that:

• the documents and information you provide are complete, accurate and genuine;
• the declared value, quantity, weight, origin and description of the goods are correct;
• you hold the licences and registrations required to import or export the goods, or you have asked us in writing to import under our own licence;
• you will tell us if the consignment contains anything restricted, regulated, dangerous, perishable or of unusual value;
• you will provide what we ask for in time for us to lodge the declaration before the goods arrive.

You remain the importer or exporter of record and bear primary legal responsibility for the consignment. Where a customs penalty, reassessment, seizure or delay arises because information you supplied was wrong or incomplete, that cost is yours, and you agree to indemnify us against claims, fines and expenses arising from it.

To file a declaration in your name we need a power of attorney (surat kuasa) authorising us to act as your PPJK. It authorises us to lodge declarations, submit documents, settle duties and taxes, and deal with customs and the other agencies on your behalf for the consignments it covers.

It authorises nothing beyond that. You can revoke it in writing at any time, and revocation takes effect once we receive it — but it does not unwind a declaration already lodged, and it does not relieve you of charges already incurred.

Indonesia restricts or prohibits a wide range of imports and exports under the LARTAS regime. Where goods are restricted, we will identify the requirement and manage the permit application with the relevant agency — BPOM, the Ministry of Trade, the Ministry of Agriculture, Karantina or another body as the case requires.

Where goods are prohibited, we will decline the instruction. We will also decline, and we want to be unambiguous about this, any request to understate a value, misdescribe goods, apply a knowingly incorrect HS code, split a consignment to avoid a threshold, or otherwise work around a customs procedure. If an instruction heads in that direction we will say so and stop.

If prohibited or undeclared restricted goods are found in a consignment we are handling, we will report it as the law requires, and the consequences — seizure, penalty, prosecution — rest with you.

Any transit time or clearance time we give you is an estimate made in good faith. Clearance speed depends substantially on the channel customs assigns to the declaration: green means release after payment, yellow means document verification, and red means document verification plus physical inspection.

That assignment is made by customs on a risk basis. Accurate, complete, early documentation is what improves the odds, and preparing it properly is our job — but no broker can promise a channel, and anyone who does is overselling.

We are not liable for delay caused by customs examination or revaluation, quarantine or agency processing, carrier schedule changes, port or terminal congestion, weather, strikes, system outages at CEISA, or public holidays.

Unless we have agreed credit terms with you in writing:

• duties, taxes and disbursements are payable in advance of us settling them, or immediately on our request;
• our service fees are payable within 7 days of invoice;
• payment is made in full, without set-off or deduction, to the account named on the invoice.

We may hold a consignment, suspend work, or decline to release documents while sums properly due to us remain unpaid. On overdue amounts we may charge interest at 2% per month, and recover the reasonable cost of collection.

Query an invoice within 7 days of receiving it. After that it is treated as accepted.

Cargo that cannot be cleared or collected accrues charges from the terminal, the carrier and the warehouse. Those charges are for your account, including where the cause is a missing document, an unobtained permit, an unpaid duty, a customs inspection, or an instruction we are waiting on from you.

We will warn you when free time is running out and what the daily cost will be. We cannot waive another party’s demurrage, and we cannot stop it accruing while a consignment sits in an inspection queue.

Where cargo is abandoned, or remains uncollected after we have asked you to collect it, we may arrange storage at your cost, and after a reasonable period deal with it as the law permits — including disposal — and recover our costs from you.

We strongly recommend insuring every consignment, and we will arrange marine or air cargo insurance on request. Unless you ask us to, no insurance is arranged, and the consignment travels uninsured.

Where we arrange it, we do so as agent: the policy is between you and the underwriter, and cover, exclusions and claims are governed by the policy wording. Declare the correct value — underinsurance reduces what you recover.

Please read clause 12 alongside this one. Our liability is limited, and insurance is what actually makes you whole if cargo is lost or damaged.

We are liable for loss you suffer as a direct result of our negligence or breach of these terms, subject to the limits below.

We are not liable for:

• loss, damage or delay caused by the act, omission, information or instruction of you or a third party, including carriers, terminals, handling agents and authorities;
• customs duties, taxes, penalties or reassessments properly assessed against the consignment;
• demurrage, detention or storage, except where it arises solely from our own error;
• indirect or consequential loss, including lost profit, lost contracts, lost production, lost market or reputational harm;
• loss or damage occurring while the goods are in a carrier’s custody, which is governed by the contract of carriage;
• anything caused by an event described in clause 17.

Where we are liable, our total liability for any one consignment is limited to the service fees we charged you for that consignment. Nothing in these terms excludes liability that Indonesian law does not permit to be excluded, including liability for fraud.

Tell us about a claim in writing as soon as you can, and in any event within 14 days of the event, or of the date you should reasonably have become aware of it. Late notice may prevent us investigating effectively or preserving a recourse claim against a carrier or insurer.

Send us what you have: the shipment reference, the documents, photographs where there is visible damage, and a survey report where one exists. We will investigate and respond.

No claim may be brought more than 9 months after the consignment was delivered, or should have been delivered.

You may cancel an instruction before work begins at no charge. Once work has begun — a declaration prepared, a permit applied for, a booking confirmed, transport dispatched — you are liable for the work done and the third-party costs committed.

We may suspend or end our engagement where sums due remain unpaid, where we are asked to do something unlawful or outside these terms, where requested documents are not provided within a reasonable time, or where continuing would put our PPJK licence at risk. Where we do, we will tell you why and hand over the documents you are entitled to, subject to clause 9.

We treat your commercial information — supplier names, pricing, volumes, product specifications and shipment patterns — as confidential, and use it only to perform the services. We disclose it only to the authorities and service providers that performing the work requires, or where the law compels us.

The text, images, structure and design of this website belong to us or to Juara Holding Group Limited. You may read, print and share pages for your own business purposes. Republishing substantial parts of the content, or using it to train or populate another service, requires our written permission.

The guidance on this site — duty rates, procedures, timelines, permit requirements — is general information, written to be accurate at the time of writing. Indonesian customs rules change, sometimes at short notice. It is not legal or tax advice, and it is not a substitute for a review of your specific consignment. Ask us before relying on it for a decision.

Where we link to another organisation’s website, we do not control its content and are not responsible for it.

Neither side is liable for failing to perform because of an event beyond its reasonable control. That includes natural disaster, volcanic activity, earthquake, flood, severe weather, epidemic, war, civil unrest, terrorism, strike or industrial action, port or airport closure, carrier failure, government action or change of law, and failure of customs or other government IT systems.

We will tell you promptly, keep you informed, and do what is reasonable to limit the effect. Charges already incurred remain payable.

These terms, and any dispute arising from them or from our services, are governed by the laws of the Republic of Indonesia.

If something goes wrong, raise it with us first — most disagreements on a shipment are resolved by looking at the documents together. Where a dispute cannot be settled by discussion within 30 days, it is subject to the exclusive jurisdiction of the competent court in Denpasar, Bali, unless we have agreed arbitration in writing.

We may update these terms, and the current version is always the one on this page, with the date shown at the top. Changes apply to instructions given after they are published; they do not alter the terms of work already in progress.

Where a change materially affects an ongoing client relationship, we will tell you directly rather than leave you to notice it here.
